What is considered driving under the influence?

It is illegal for any person to drive or operate a motor vehicle while:

  • The person has a Blood Alcohol Content (BAC) of 0.08 or more;

  • The person is under the influence of alcohol;

  • The person is under the influence of any drug(s) to such an extent that it impairs the driver’s ability to operate the vehicle safely

  • The person is under a combined influence of alcohol and any drug(s) to such an extent that it impairs the driver’s ability to operate the vehicle safely

  • The person has 0.02 milligram per liter of blood of cocaine, 0.1 milligram of methamphetamine per liter of blood, or 0.01 milligram of PCP per liter of blood.

What penalties could I face if charged with a DUI?

  • Penalties For Driving Under The Influence In The Commonwealth Of Virginia Can Be Determined By How Many Prior DUI Convictions The Individual Has Had In The Past. Also, Additional Enhanced Penalties Can Be Added For Higher BAC Levels And Having A Minor In The Vehicle While Driving Under The Influence.

  • If an individual is convicted of driving under the influence (1st or 2nd offense), then that individual could face up to 12 months in jail and a fine of $250 to $2,500.

  • If the person has a BAC of at least 0.15, then the individual also has the possibility of additional jail.
