Attorneys in Central and Northern Virginia
One of the most common disputes between landlords and tenants is late rent. While sometimes tenants may just forget, other times it can be a case of malicious intent. Regardless, it is irresponsible and a breach of contract. When a tenant does fail to pay rent on time, landlords can take steps to help them with the recovery of the late payment. If you do have a tenant that does not pay rent on time, it will become necessary to take legal action.
At Gilliam & Mikula we can assist you with all issues arising from residential and commercial leases. What should I do if my tenant has stopped paying rent?
If your tenant stops paying rent, you must give them a notice called a 5 Day Pay or Quit. This informs the tenant of the default and how much they owe to bring the lease current. This includes past due rent, late fees, damages and possibly attorney’s fees.
Why should I hire an attorney instead of doing it myself?
Landlord Tenant law can be confusing, and it is getting more complicated. If you make a mistake anywhere in the process you may have to start over. This will significantly increase the time it takes to have the delinquent tenant removed from your property. There are a number of steps which must be taken before the tenant can be ” evicted”. Using an attorney familiar with landlord/tenant law will insure a faster and much more efficient process.
